These Terms & Conditions govern the use of DIZON and purchases made from Digital Bacon Ltd. Please read them before creating an account, purchasing a membership or purchasing or using an Artwork Identity.

1. Provider and scope

DIZON is operated by Digital Bacon Ltd, Solonos Michailidi 6, Chloraka Pines, House 4, 8220 Chloraka, Paphos, Republic of Cyprus, company registration number HE406662 (“DIZON”, “we”, “us”). These Terms apply to the DIZON website, dashboard, Wallet app, memberships, Artwork Identities and related services.

If you use DIZON on behalf of a business or organisation, you confirm that you are authorised to bind that organisation. Mandatory consumer rights remain unaffected.

2. The DIZON service

DIZON enables artists and authorised users to create and manage digital identities connected with artworks and enables owners to access associated artwork and ownership information through the DIZON Wallet.

An Artwork Identity records information supplied by artists, owners or other authorised users. It can serve as a digital certificate issued by the artist or another authorised user. DIZON does not independently authenticate, appraise or verify an artwork, its provenance, authorship, value or legal ownership unless expressly agreed in writing. An Artwork Identity is not itself a title document and does not transfer legal ownership of the physical artwork.

3. Accounts and eligibility

  • You must provide accurate and current information and keep your login credentials secure.
  • You must be at least 18 years old or have legal authority to enter into the contract.
  • You are responsible for activity conducted through your account and must promptly report suspected unauthorised access.
  • Accounts and services may not be used for fraud, infringement, unlawful content or misleading authenticity or ownership claims.

4. Memberships

DIZON Artist memberships are available with monthly or annual billing as shown at checkout. Memberships renew automatically for the same billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid billing period.

The Founding Artist price applies to the first 12 months of an eligible new membership. Unless cancelled, the membership then renews at the regular price displayed when the order is placed: currently €12.90 per month for monthly billing or €129.00 per year for annual billing. The Founder designation and membership functions are active only while an eligible membership remains active.

We may change future membership prices by giving reasonable advance notice. A price change will not affect a billing period already paid. You may cancel before the new price takes effect.

5. Artwork Identities

  • An active membership is not required to purchase Artwork Identity bundles.
  • Artwork Identities may also be issued free of charge as part of promotions.
  • Unused Artwork Identities do not expire unless different terms were clearly stated for a specific promotion.
  • Transfer or refund of an unused Artwork Identity may be considered on request and remains subject to applicable law and verification.
  • An Artwork Identity already assigned to an artwork remains associated with that artwork after a membership ends.
  • Assignment of an Identity is not a substitute for a sale agreement or other legal transfer document for the physical artwork.

6. User content and authority

You retain your rights in artwork images, descriptions and other content you provide. You grant Digital Bacon Ltd a non-exclusive, worldwide licence to host, reproduce, display, format and transmit that content only as needed to provide, secure and promote the DIZON service and the relevant public Identity Card.

You confirm that you are entitled to provide the content and create or manage the relevant Identity, and that the content is accurate, lawful and does not infringe third-party rights. You are responsible for obtaining permissions from artists, owners, photographers and other rights holders where required.

7. Orders, prices and payment

A contract is formed when we accept your order or activate the purchased service. Prices and the applicable billing period are displayed before purchase. Prices shown to consumers include applicable VAT. Prices may be displayed in an adapted local currency; the final amount and currency are shown at checkout. Your bank or payment provider may apply its own conversion or transaction charges.

Payment is processed by the payment method and payment service provider shown at checkout. We do not ordinarily receive complete payment card details. You will receive an electronic order or payment confirmation.

8. Cancellation, withdrawal and refunds

Cancellation stops the next automatic renewal but does not normally create a refund for the current billing period. This does not limit statutory refund or withdrawal rights.

If you are a consumer in the European Union or European Economic Area, you generally have 14 days from conclusion of a distance contract to withdraw without giving a reason. To exercise this right, send an unequivocal statement to info@dizon.io or to our registered address before the period expires.

If you expressly request that a service begins during the withdrawal period and later withdraw, we may charge a proportionate amount for the service supplied before withdrawal where permitted by law. For digital content supplied immediately, the right of withdrawal may be lost only where the legal requirements, including prior express consent and acknowledgement, have been satisfied. Statutory rights for defective or non-conforming digital services remain unaffected.

Approved refunds are made to the original payment method unless otherwise agreed or legally required.

9. Availability and changes to the service

We aim to keep DIZON available and secure but do not guarantee uninterrupted operation. Maintenance, security incidents, third-party services or events beyond our reasonable control may temporarily affect availability. We may improve or modify features, provided this does not unlawfully reduce a paid service during its current billing period.

10. Suspension and termination

We may restrict or suspend an account where reasonably necessary to investigate fraud, security risks, infringement, unlawful conduct, non-payment or a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to remedy the issue. We may preserve information where required by law or necessary to protect legitimate claims.

11. Intellectual property

The DIZON platform, software, name, branding and original service materials are owned by or licensed to Digital Bacon Ltd. Except for the limited right to use the service under these Terms, no platform intellectual property rights are transferred to users.

12. Liability

Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer protections. Subject to that limitation, Digital Bacon Ltd is not responsible for inaccurate information supplied by users, disputes regarding authenticity or ownership, unauthorised use caused by a user’s failure to secure an account, or indirect losses that were not reasonably foreseeable when the contract was formed.

For business users only, and to the maximum extent permitted by law, our aggregate liability arising from a paid service is limited to the amount paid by that business user for the affected service during the 12 months preceding the event giving rise to the claim.

13. Privacy

Our processing of personal data is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus. For business users, the courts of the Republic of Cyprus have exclusive jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections or jurisdiction rights available under the law of your country of habitual residence.

Please contact us first at info@dizon.io so that we can try to resolve a concern directly. Information about recognised consumer dispute resolution bodies in the EU is available from the European Commission’s Consumer Redress portal.

15. Changes to these Terms

We may update these Terms for legal, security, operational or service-related reasons. Material changes affecting active paid memberships will be notified reasonably in advance. Changes do not retrospectively remove rights relating to an order already accepted.
